NOTICE OF PUBLIC HEARING

September 5, 2023 at 5:00 p.m.

Applicable to the following Electoral Areas:

  • Electoral Area A – Mill Bay/Malahat; Electoral Area B – Shawnigan Lake;
  • Electoral Area C – Cobble Hill; Electoral Area D – Cowichan Bay;
  • Electoral Area E – Cowichan Station/Sahtlam/Glenora;
  • Electoral Area F – Cowichan Lake South/Skutz Falls;
  • Electoral Area G – Saltair/Gulf Islands; Electoral Area H – North Oyster/Diamond
  • Electoral Area I – Youbou/Meade Creek

Notice is hereby given that a Public Hearing will be held electronically Tuesday, September 5, 2023, at 5:00 p.m. by delegates of the Regional Board of the Cowichan Valley Regional District to consider

the following bylaws:

Official Community Plan Amendment Bylaw No. 4424, 2023;

Zoning Amendment Bylaw No. 4485, 2023; and

Official Community Plan Amendment Bylaw No. 4484, 2023.

PURPOSE OF THE PROPOSED BYLAW

CVRD Bylaw No. 4424 - Official Community Plan Amendment Bylaw, 2023

The purpose of the proposed Bylaw is to amend the exemptions from the development permit requirements in Bylaw No. 4270; modify the definition of “development” in the bylaw to include alteration or removal of vegetation and the deposit or removal of soil materials; add details on the interpretation of land use designation boundaries; update hyperlinks to material on fish habitat protection and invasive plant species; and update mapping for the existing development permit areas in Schedule U to Bylaw No. 4270 and the mapping of agricultural land in Schedule D, including consequential amendments to the text of the bylaw.

CVRD Bylaw No. 4485 – Zoning Bylaw for the Electoral Areas, 2023

The purpose of the proposed Bylaw is to continue in force the development permit guidelines and exemptions, as amended by Bylaw No. 4424, that are being removed from Bylaw No. 4270 by Bylaw No. 4484. Locating this material in a zoning bylaw will facilitate future amendments to the guidelines and exemptions, and enable bylaw users to access both regulatory and guideline information in a single source. The guidelines and exemptions to be incorporated into a zoning bylaw are identical to those contained in Bylaw No. 4270 as amended by Bylaw No. 4424. Development permit area designations and mapping and related material would remain in Bylaw No. 4270.

CVRD Bylaw No. 4484 - Official Community Plan Amendment Bylaw, 2023

The purpose of the proposed Bylaw is to remove from Bylaw No. 4270 the development permit guidelines and exemptions that are being incorporated into Bylaw No. 4485.

The deadline for written submissions is 4:30 p.m. on September 5, 2023. Please include your name and address in your submission. Prior to the Public Hearing, all submissions are placed in the Public Hearing Binder located at the Cowichan Valley Regional District Land Use Services Department front counter, and posted online at www.cvrd.bc.ca/PublicHearings, for viewing. All submissions will form part of the Public Hearing record. Please note that personal information, including phone numbers and email addresses should not be included in your submission, and other personal information protected under the Freedom of Information and Protection of Privacy Act, will be redacted before being published online by the CVRD.

FURTHER INFORMATION

Please note the Public Hearing is not a question-and-answer session. The purpose of the Public Hearing is for members of the public to make representations on the proposed Bylaws to the Regional Board’s delegates. A copy of the proposed Bylaws and other documents that may be considered by the Board in determining whether to adopt the Bylaws, are available for public inspection online at www.cvrd.bc.ca/PublicHearings; and at the Cowichan Valley Regional District Land Use Services Department front counter located at 175 Ingram Street, Duncan, BC, from August 24, 2023 to September 5, 2023, between the hours of 8:00 a.m. and 4:30 p.m., Monday through Friday, excluding statutory holidays.

Copies of the following documents that may be considered by the Regional Board in determining whether to adopt Bylaw No. 4424, 2023, Bylaw No. 4484, 2023 and Bylaw No. 4485, 2023 will be available for inspection by members of the public on the CVRD website at www.cvrd.bc.ca/PublicHearings:

  • Proposed CVRD Bylaw No. 4484 – Official Community Plan Amendment Bylaw, 2023

  • Staff reports to the regional board on the proposed Bylaws
  • Written submissions received by the CVRD to date on the proposed Bylaws
  • The resolution of the Regional Board delegating the holding of the public hearing on the proposed Bylaws

Decisions concerning the adoption of the proposed Bylaws will not be made until the record of Public Hearing is received and considered by the Regional Board. Please be advised that the Board cannot

receive public submissions following the close of the Public Hearing.
