Controversial project can continue to import soil

A controversial project on Stebbings Road in Shawnigan Lake will be allowed to continue to import soil

A controversial project on Stebbings Road in Shawnigan Lake will be allowed to continue to import soil, the BC Court of Appeal decided on Friday.

But South Island Resource Management, which operates the site, will only be allowed to import soil until the court holds a hearing in mid-August.

That court date is to hear the appeal the project's proponents submitted after the BC Supreme Court ruling last month that declared a contaminated soil treatment facility and a landfill facility are not permitted uses on the property.

As a result, the court at the time ordered the owners and operators to cease importing waste material, including contaminated soil, to the site.

“The Shawnigan community is disappointed with the judge's decision to allow more soil to be imported to this site while there is so much uncertainty,” said Sonia Furstenau, the Cowichan Valley Regional District director for Shawnigan Lake.
