Notice of Proposed Property Disposition by way of Statutory Rights of Way

Notice is hereby given, pursuant to sections 26 and 94 of the Community Charter, that the Municipality of North Cowichan intends to dispose of land by way of three Statutory Right of Ways (“SRWs”) to the Municipality of North Cowichan.

The Municipality is working with the Community Land Trust to develop 92 units of affordable housing at 3191 Sherman Road. As part of the development approvals process, the Municipality needs to ensure future access and drainage is secured through SRWs. As such the following SRW’s are being granted:

The land to be disposed of by SRW is: those parts of 3253 Sherman Rd, legally described as Lot 1, Section 1, Range 4, Somenos District, Plan 18897 (PID: 003-809-471) shown outlined in bold and labelled “Area 1” and “Area 2” on Plan EPP142675 (below left); and those parts of 3191 Sherman Rd, legally described as Lots A & B, Section 1, Range 4, Somenos District, Plan EPP129564 (previously Lot 2, PID: 003-809-510) shown outlined in bold and labelled “SRW Area 1” and “SRW Area 2” on Plan EPP142681 (below right).

The consideration to be received by the Municipality for the disposition is $1 for each SRW. The SRWs provide for public access (Area 1), parking (Area 2) & municipal drainage works (Areas 1 & 2 on SRW Plan EPP142675); and multi-use pathway & drainage works (SRW Areas 1 & 2 on SRW Plan EPP142681).

North Cowichan’s Approving Officer will, under delegated authority, consider approval of the SRWs following publication of the required notice. For more information, please contact legislativeservices@northcowichan.ca
